Distribution of LBD Proceeds Under New Law

On May 14, Governor Haslam signed Public Chapter 901 into law, which addressed the majority of the issues and questions concerning liquor-by-the-drink revenues (mixed drink tax). Public Chapter 901, implemented a more clearly defined process governing the distribution and allocation of liquor-by-the-drink revenues was to be implemented with respect to proceeds collected after July 1. Yesterday, August 20, your city should have received, from the Tennessee Department of Revenue, payment of the liquor-by-the-drink proceeds collected in your city during the month of July. As such, this payment represents the first proceeds received that are to be distributed by your city under the requirements of the new law. At the top of this document you will find a link to Public Chapter 901 as well as several documents summarizing the distribution process and other aspects of the new law. If you have any questions concerning the proper distribution of these proceeds, please contact your TML staff at 615-255-6416. In addition, I invite your attention to two deadlines discussed in the document titled, “Summary of Key Dates.” In particular, I call your attention to the obligation of each city that has adopted a liquor-by-the-drink ordinance to notify any school system in which children residing within the city are enrolled. This notification was to be made to the respective systems by August 1. If your city has not made such notice, I would urge you to do so immediately.
